Al is an experienced trial attorney who has litigated numerous cases in state and federal courts at the trial and appellate levels. His experience includes obtaining reversal by the Supreme Court of Texas of multiple trial court orders requiring production of irrelevant and privileged information. He also has significant multi - district litigation experience and has successfully moved for the creation of MDL dockets for multiple clients.

  • Experience
    • Integral role in successful mandamus of a discovery order from trial court granting motion to compel production of documents concerning defendant’s attorney’s fees. The Supreme Court of Texas held that the billing records were irrelevant and that the order invaded work-product privilege. In re Nat’l Lloyds Ins. Co., 532 S.W.3d 794 (Tex. 2017).
    • Integral role in successful mandamus of a discovery order from trial court granting motion to compel production of client’s internal management reports and associated emails in first party bad faith litigation. In re Nat’l Lloyds Ins. Co., 507 S.W.3d 219 (Tex. 2016).
    • Integral role in successful mandamus of a discovery order from trial court compelling defendant to produce claim files from unrelated claims in first party bad faith litigation. In re Nat’l Lloyds Ins. Co., 449 S.W.3d 486 (Tex. 2014).
    • Second chair trial counsel for commercial property insurer in multi-million dollar bad faith litigation. The jury found no breach of contract, no bad faith, and that the carrier was prejudiced by the late reporting of the claim.
    • Obtained post-appraisal summary judgment on a multi-million dollar appraisal claim and had the judgment affirmed by the Amarillo Court of Appeals. Abdalla v. Farmers Ins. Exchange, 2018 WL 2220269 (Tex.App. – Amarillo May 14, 2018, no pet.).
    • Second chair trial counsel for residential property insurance carrier sued for bad faith handling of a Hurricane Ike claim. Obtained JNOV following jury verdict awarding , which was affirmed on appeal. John Davis d/b/a J.D. House of Style v National Lloyds Insurance Company; 484 S.W.3d 459 (Tex.App. – Houston [1st Dist.] 2015, pet. denied).
    • Successfully handled defense of pipeline general contractor and pipeline owner in lien foreclosure suit by E&I subcontractor.
    • Obtained summary judgment on behalf of inland marine insurer against insured’s vendor seeking third party beneficiary status under the insurance policy.
    • Successfully handled defense of pipeline general contractor and pipeline owner in suit by property owner claiming seismic damage from pipeline construction.
